Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 26.02.2022 in connection with Bhubaneswar P.S. Case No.32 of 2022 corresponding to T.R. Case No.76 of 2022 pending in the Court of learned Sessions Judge, Khurda for the alleged commission of offence under Sections 20(b)(ii)(C) of NDPS Act.

Though it is stated that the contraband was seized from the possession of the petitioner, yet as submitted by learned counsel for the petitioner, there is some discrepancy with regard to the mode of search and seizure as also weighment of the seized contraband. 5.
Considering the above facts and the period of detention, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail including the condition that he shall furnish cash security of Rs.50,000/- (Rupees Fifty Thousand)
and further he shall not leave the territorial jurisdiction of the Court without obtaining leave.

BLAPL is accordingly disposed of.
