This matter is taken up through hybrid arrangement (virtual/physical mode).

2. Petitioner, a Private Limited Company is engaged in the business of operating a Hotel under the name and style as Dwaraka in the city of Cuttack. The Hotel also has a licence for operating an IMFL 'ON' Shop within the premises of the Restaurant.

3. By filing the present Writ Petition, challenge has been laid to the hike in excise duty for the Excise Year 2013-2014 and onwards.

4. This Court while issuing notice to the Opposite Parties on 6th May, 2014 had extended no interim protection.

5. At the time of hearing today, learned counsel for the petitioner states that the present Writ Petition has become infructuous in view of the petitioner having accepted the levy of the excise duty at the enhanced rate.

6. In view of the above, the Writ Petition is dismissed as infructuous.
