Ananda Chandra Sahoo v. Manorama Das
IN THE HIGH COURT OF ORISSA AT CUTTACK
CRLMC No.3745 of 2015 Ananda Chandra Sahoo and others ....
Petitioners Mr. B. Pujari, Advocate -versusManorama Das ....
Opp. Party Mr. P.K. Pattanaik, A.G.A.
CORAM:
JUSTICE G. SATAPATHY Order No.
ORDER
27.09.2022 06.
1.
This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).
2.
None appears for the petitioners at the time of call, so also no one had appeared on behalf of the petitioners when the matter was taken up on 17.08.2022 and 15.09.2022.
The petitioners by way of this application U/S. 482 of Cr.P.C. seeks to quash the order passed on 10.07.2015 by learned J.M.F.C., Chandabali in 1.C.C. Case No.55 of 2015 taking cognizance of offences but no stay has been granted from proceeding further in the complaint and in the meantime, around seven years have passed from the date of passing of the impugned order.
In view of the above facts, this Court reasonably entertains a doubt as to whether the cause of action still survives for the petitioners in this case.
3.
In view of the above, the CRLMC is dismissed. Subhasmita (G. Satapathy) Judge
