1. Heard Mr. J. Sahoo, learned counsel for the Petitioner as well as Mr. K. Das, learned A.S.C. for the State-Opposite Party.
2. It is submitted that the Petitioner was earlier released on bail pursuant to the order of this Court dated 8.4.2016 passed in BLAPL No.1227/2016 in G.R. Case No.89/2015 corresponding to R. Udayagiri P.S. Case No.54/2015 pending in the court of learned Sessions Judge, Gajapati, Parlakhemundi for alleged offences under Sections 363/370(5)/34, I.P.C. and Section 14(1) of the Child Labour Prohibition and Regulation Act, 1986. After commitment, the case was registered as S.T. Case No.15/2016(A) in the court of learned Sessions Judge, Gajapati, Parlakhemundi. Subsequently due to this non-appearance before the court below, for the reason of communication gap with his lawyer, the NBW of arrest was issued against him by order dated 26.02.2020.
3. Thus considering the limited nature of prayer and after hearing learned counsel for the State, in the interest of justice, the CRLMC is disposed of with a direction that in the event the Petitioner surrenders on or before 06.06.2022 before the learned court below, he be released on bail in the aforesaid case on such terms and conditions to be fixed by the learned court below in seisin over the matter.
4. It is made clear that failing to surrender within the time stipulated above, this order shall not be given effect to.
5. The CRLMC is disposed of.
6. An urgent certified copy of this order be granted on proper application.
