Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 05.02.2022 in connection with Banpur P.S. Case No.43 of 2022 corresponding to G.R. Case No.38 of 2022 pending in the Court of learned J.M.F.C., Banapur for the alleged commission of offence under Sections 498A/302/304-B/34 of IPC. 4.

It is alleged that the petitioner being the husband of the deceased used to subject her to cruelty in connection with demand for dowry. On the date of occurrence the deceased consumed poison and died two days later. In the dying declaration recorded by the doctor it is stated that she had consumed poison due to anger.

Considering the above facts, the materials on record and the period of detention in custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally

appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.

Issue urgent certified copy as per rules.
