Heard Mr. Behera, learned counsel for the Petitioner and Mr. Dash, learned AGA.

According to Mr. Behera, the Petitioner is aggrieved by inaction of Opposite Parties in extending the benefit of rehabilitation assistance for acquisition of land for Lower Indra Irrigation Project, Khariar in the district of Nuapada under the provisions of Odisha Resettlement and Rehabilitation Policy, 2006. He further submits that though the Petitioner has submitted application in appropriate Forms under Annexure-3 series on 5th August, 2020 before the Project Director (R & R), Lower Indra Irrigation Project, Khariar-Opposite Party No.4, however, nothing has been done so far. In such background, he seeks for a direction to Opposite Party No.4 to consider the case of the Petitioner within a specified time.

Considering the submission made and without expressing any opinion on the merit of the case, this Court directs Opposite Party No.4 to take a decision on the above mentioned applications under Annexure-3 series in accordance with law

// 2 // within a period of eight weeks after giving opportunity of hearing to the Petitioner. While presenting the certified copy of this order, the Petitioner is directed to supply copies of the documents under Annexure-3 series to Opposite Party No.4. 5.

With the direction as aforesaid, the writ petition is disposed of.

Issue urgent certified copy of the order on proper application.
