1. Since an assessment order has already been passed, the Court permits the Petitioner to withdraw the present petition to avail of the statutory remedy of an appeal in accordance with law. Any explanation offered before the CIT(A) for the delay in filing the appeal on account of pendency of the present petition will be considered on merits by the CIT(A). All points urged in the present petition are permitted to be urged before the CIT(A).
