2. Heard Mr. U.C. Mohanty, learned counsel for the petitioner and Mr. T. Patnaik, learned Additional Standing Counsel for the State.

The petitioner has filed this writ petition challenging the action of the opposite parties in not closing the contract and not releasing the outstanding undisputed dues of the petitioner for about Rs.15,73,304/-, despite submission of the Inspection Report by the Superintendent Engineer, Drainage Circle, Balasore dated 09.10.2014 under Annexure-8 and the recommendation for closure of the same in view of the instructions of DOWR dated 25.10.2017 and 09.12.2019 under Annexures-6 and 7. 4.

Learned counsel for the petitioner contended that despite submission of the Inspection Report by the Superintendent Engineer, Drainage Circle, Balasore dated 09.10.2014 under Annexure-8 and the recommendation for closure of the same in view of the instructions of DOWR dated 25.10.2017 and

09.12.2019 under Annexures-6 and 7, the opposite parties have not taken any decision. He further contended that highlighting the grievances, the petitioner has made a representation to opposite party No.1 vide Annexure-10 and the same may be directed to be considered within a stipulated time, taking into consideration Annexure-6, 7 and 8, to which learned counsel for the State has no objection. 5.

As agreed to by learned counsel for the parties, this Court, disposes of the writ petition directing opposite party No.1 to consider the representation filed by the petitioner vide Annexure-10, taking into consideration Annexures-6, 7 and 8, and pass appropriate order in accordance with law within a period of two months from the date of production of certified copy this order.
