Heard learned counsel for the parties.

The petitioner has filed this writ petition seeking to quash the order dated 30.10.2019 under Annexure-4, and to issue direction to opposite party no.1 to allow the petitioner the revised UGC scale of pay with effect from 01.06.1988 as per resolution dated 6th October, 1989 under Annexure-6 and as per the ratio decided in the case of Ajoy Kumar Das v. State of Orissa (W.P.(C) No. 15481 of 2005 disposed of on 04.12.2008) and upheld by the apex Court in Civil Appeal No. 3793 of 2012 disposed of on 23.04.2012 and State of Orissa v. Mamata Mohanty, 2011 (I) CLR (SC) 494.

In course of hearing, learned counsel for the petitioner states that highlighting the grievance, the petitioner has made representation to opposite party no.1 vide Annexure-8 and direction may be given to consider and dispose of the same, taking into consideration the judgment of this Court in the case of Banalata Mohapatra v. State of Odisha (W.P.(C) No. 14492 of 2017 disposed of on 05.04.2018), within a stipulated time, to which learned State Counsel has raised no objection. 5.

As agreed by learned counsel for the parties, this Court without expressing any opinion on the merits of the case, disposes of the writ petition directing the opposite party no.1 to take a decision on the representation filed by the petitioner vide Annexure-8 and pass

appropriate order in accordance with law taking into consideration the judgment of this Court in the case of Banalata Mohapatra v. State of Odisha (W.P.(C) No. 14492 of 2017 disposed of on 05.04.2018), within a period of three months from the date of production of certified copy of this order by the petitioner.

Issue urgent certified copy as per rules.
