30.8.2022 6 1. This matter is taken up through hybrid mode.

2. Mr. S.K.Ray, learned counsel for appellant placed one memorandum before us showing that being failed in his initiative to get instruction from the appellant, finally issued a registered letter dated 25.7.2022. Even thereafter no instruction has been received and the appellant has not met him for communicating the instruction. He has fairly submitted that he would not place any further submission for the appellant in the emerged circumstances.

3. Having situation thus, we dismiss this appeal for nonprosecution. Memorandum filed by Mr. Patnaik, learned counsel appearing for appellant be taken on record.
