Heard Mr.P.K.Behera, learned counsel for the petitioner and Mr.A.K.Nanda, learned Addl. Government Advocate. 2.

According to Mr.Behera, the petitioner is aggrieved by non-extension of benefits of Resettlement and Rehabilitation under the scheme prepared for the said purpose in connection with Kanpur Major Irrigation Project by the Water Resources Department under Annexure-3 though he belongs to the category of the displaced family. According to him as per Government scheme, the petitioner is entitled to four acres of non-irrigated agricultural land or two acres of irrigated land for cultivation purpose in addition to the compensation that has already been paid to him. He also submits that neither homestead land nor agricultural land has been provided to him. He further submits that though highlighting the grievances the petitioner along with others have approached the Project Director (Rehabilitation and Resettlement), Kanpur Irrigation Project, Basudevpur (OP No.9) on 12.2.2019 under Annexure-6 by filing a grievance petition, but till date nothing has been done. Rather an attempt is being made to dispossess the

// 2 // petitioner from the present place of residence. In such background, he submits that a direction may be issued to the Opposite Party No.9 to take a decision on the above noted grievance petition within a specified time period and till a decision is taken on the grievance petition the interest of the petitioner be protected.

Considering such submissions, this Court without expressing any opinion on the merits of the case, directs the Opposite Party No.9 to take a decision on the above noted grievance petition of the petitioner under Annexure-6 in accordance with law within a period of three months from the date of receipt of certified copy of this order and communicate result of such exercise to the petitioner. Till disposal of the grievance petition, no coercive action shall be taken against the petitioner.

The writ application is accordingly disposed of. 5.

Urgent certified copy of the order be granted on proper application.
