Heard Mr. P.C. Mishra, learned counsel for the petitioner and Mr. H.M. Dhal, learned Additional Government Advocate. 2.

According to Mr. Mishra, since the petitioner was dissatisfied with the quantum of award in L.A. Case No. 41 of 2015, he approached the Arbitrator-cum-Collector, Deogarh (Opposite Party No.2) by filing an application under Section-3G (5) of the National Highways Act, 1956 on 22.03.2019 praying for higher compensation under Annexure-3. The grievance of the petitioner is that till date the above noted application has remained undisposed. Accordingly, he prays that a direction be issued to the Opposite Party No.2 to take a decision on the above noted application of the petitioner under annexure-3 within a specific time period.

Considering the submissions made and without expressing any opinion on the merit of the case, this Court directs the Arbitrator-cum-Collector, Deogarh (Opposite Party No.2) to take a decision on the above noted application in accordance with law within a period of six months from the date of production of certified copy of this order after giving reasonable opportunity of hearing to the petitioner as well as the other interested parties concerned and communicate the result of such exercise to the petitioner.

Accordingly, this writ petition is disposed of. 5.
