This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State.

This is an application under section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Choudwar P.S. Case No.126 of 2022 corresponding to G.R. Case No.663 of 2022 pending in the Court of learned J.M.F.C. (R), Cuttack for alleged commission of offences under sections 467/468/471/ 500 of the Indian Penal Code.

As per the order dated 10.05.2022 while granting interim protection to the petitioner, he was directed to appear before the Investigating Officer on

// 2 // 18th May 2022 and cooperate with the investigation and further appear before the Investigating Officer as and when required and notice to that effect shall be given to the petitioner in advance.

Learned counsel for the State was asked to obtain instruction as to whether the petitioner appeared before the Investigating Officer on the date fixed and whether he co-operated with the investigation or not.

Today, learned counsel for the State has produced the written instruction dated 28.06.2022 received from the Inspector in-charge of Choudwar police station from which it appears that the petitioner has appeared before the Investigating Officer and cooperated with the investigation.

Considering the submissions made by the learned counsel for the respective parties, the nature of accusation against the petitioner and there is absolutely no material that he has flouted the terms and conditions of the interim order dated 10.05.2022, the said order is made absolute.

The ABLAPL is accordingly disposed of.

Urgent certified copy of this order be granted on proper application.
