Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 03.03.2022 in connection with Gurudijhatia P.S. Case No.142 of 2021 corresponding to C.T. Case No.539 of 2021 pending in the Court of learned S.D.J.M., Athagath for the alleged commission of offence under Sections 407/420/468/471/34 of the of IPC.

It is alleged that the petitioner in association with another person took away a truck load of sponge iron from the company of the informant amounting to Rs.20,65,981.76/-. In course of investigation the truck along with the materials has been seized. 5.

In such view of the matter, this Court finds no justified reason to detain the petitioner in custody any longer. The bail application is therefore allowed. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall furnish cash security of Rs.1 lakh in the shape of short term deposit in any nationalized bank. Such deposit shall be without prejudice to

the rival claims. Further he shall not leave the territorial jurisdiction of this Court without obtaining the leave. 6.

BLAPL is accordingly disposed of.
