Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 12.01.2022 in connection with Tangi P.R. No. 90/2021-2022 corresponding to T.R. Case No.4 of 2022 pending in the Court of learned 1st Additional Sessions Judge-cumSpecial Judge under NDPS Act, Khorda for the alleged commission of offence under Sections 20(b)(ii)(B) of NDPS Act. 4.
The prosecution allegation is that the petitioner was caught red handed while carrying ganja weighing 8 kg in a polythene bag. 5.
Considering the submissions, materials on record and the fact that the seized contraband is less than commercial quantity, I am incline to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
