1. Learned counsel appearing for the Petitioners seeks leave to withdraw the present petition with liberty to avail the statutory remedy of an appeal in accordance with law against the impugned order. If such appeal is filed not later than 1st February, 2023 accompanied by an application for condonation of delay explaining the delay on account of the pendency of the present petition, it shall be considered in accordance with law by the concerned Court. The Court clarifies that it has not expressed any view on merits.

2. Accordingly, the CRLMC is disposed of as withdrawn with liberty as prayed for in the above terms. The interim order passed earlier stands vacated.

3. The Superintendent of the concerned Branch is directed to immediately communicate this order to the concerned Subordinate Court.
