This matter is taken up through Hybrid Arrangement (Video Conferencing/Physical Mode).
Heard learned counsel for the petitioner and the learned counsel for the State.
This is an application under section 439 of Cr.P.C. in connection with G.R. Case No.20 of 2020 arising out of Mohana P.S. Case No.43 of 2020 pending in the Court of learned Special Judge, Gajapati, Paralakhemundi for alleged commission of offence punishable under section 20(b)(ii)(C) of the N.D.P.S. Act.
The petitioner moved an application for bail before the Court of learned Special Judge, Gajapati at Paralakhemundi which was rejected on 07.02.2022.
// 2 // Perused the status report dated 03.10.2022 submitted by the learned trial Court from which it appears that the case was posted to 12.10.2022 for defence evidence.
In view of the stage of the trial, I am not inclined to release the petitioner on bail.
Accordingly, the BLAPL stands dismissed.
