The Petitioner in this CMP seeks to assail the order dated 23rd July, 2016 (Annexure-7) passed by learned Civil Judge (Junior Division), Kesinga in Execution Case No.1/9/2 of 201015. 3.

In course of hearing, Mr. Panda, learned counsel for the Petitioner submits that the matter has already been settled out of Court and prays for withdrawal of the CMP. In support of his contention, he files a memo in Court, which is taken on record. 4.

In view of the above, the CMP is dismissed as withdrawn.
