1. In view of the order of this Court dated 5th July, 2022 in ITA No.94 of 2018 (Principal Commissioner of Income Tax (Central) v. M/s. Midas Capital Pvt. Ltd.), the questions urged by the Revenue in the present appeal which is directed against the order dated 5th December, 2018 of the Income Tax Appellate Tribunal, Cuttack (ITAT) in ITA No. 204/CTK/2018 for the assessment year 2009-10 are declined to be framed.
