Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 31.08.2022 in connection with Cuttack P.S. Case No.430 of 2020 corresponding to G.R. Case No.1866 of 2020 pending in the Court of learned J.M.F.C.(R), Cuttack for the alleged commission of offence under Sections 394/411/34 of IPC.

The prosecution allegation is that an unknown person came in a motor cycle and snatched the gold chain from the neck of the informant's wife in between Pratap Nagari and Telengapentha. In course of investigation, the petitioner's complicity came to light and he was arrested. The petitioner was also identified correctly in T.I. parade.

However, taking into consideration the fact that charge sheet has already been submitted as also the period of detention in custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the
court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case failing which necessary orders may be passed to take him to custody again by the Court below. Further he shall appear before the IIC of Cuttack Sadar Police Station on every Monday at 10.30 a.m. for a period of six months.

BLAPL is accordingly disposed of.
