Heard learned counsel for the Petitioner and learned counsel for the Opposite Parties through caveat.

This Court finds, the Petitioner has lost in both the forums. Attempt of the Petitioner to obtain injunction under the provision of Order 39 Rule 1 & 2 C.P.C. has been rejected and the same has also been confirmed in appeal. Grounds raised before the trial court was also urged before the lower appellate court and both the Courts after considering such grounds have come to the concurrent view. In the circumstance, this Court finds no scope for interfering in such orders. It is, at this stage of the matter, Mr. Behera, learned counsel for the Petitioner prays for a direction for expeditious disposal of the suit. Learned counsel for the Opposite Parties submitted that there is already filing of the W.S. involving the C.S. No.276 of 2016. This Court, in the circumstance, directs, in the event the pleadings in the C.S. No.276 of 2016 are already completed, the learned Senior

// 2 // Civil Judge, Rourkela is requested to see disposal of the C.S. No.276 of 2016 at least within a period of nine months from the date of communication of an authenticated copy of this order by the Petitioner. Both the parties are restrained from taking unnecessary adjournment in the Court below.
