This matter is taken up by virtual/physical mode. This contempt application has been filed by the Petitioner alleging non-compliance of order dated 24th November, 2021 passed in W.P. (C) No. 11961 of 2020 within stipulated period of time as directed in the said order.

The grievance of the Petitioner in the writ petition is that, there has been in-action on the part of the Opposite Parties in not releasing the legitimate dues of the Petitioner, even though the Chief Engineer National Highways of Odisha has recommended. 4.

Mr. Aditya Mohanty, Advocate on behalf of Mr. Sidharth Shankar Padhy, Advocate for the Petitioner brought to the notice of the Court that a memo of withdrawal supported by the affidavit has been filed on 4th April, 2022 before this Court. Perusal of memo withdrawal reflects the following:

// 2 // "The Petitioner prays for withdrawal of the contempt petition as the Opposite Party-Contemnor in the meantime has assured to redress the grievance of the Petitioner and make payment. The Petitioner further begs liberty to file a fresh application in case of non-redressal of the grievances"

Mr. Anupam Rath, Additional Standing Counsel has no objection for such withdrawal as prayed for by the Petitioner. 6.

The contempt petition is allowed to be withdrawn with the aforesaid liberty as conceded by the both the counsel for the respective parties.
