This matter is taken up through Hybrid arrangement (video conferencing/physical mode).

Heard learned counsel for the petitioners and learned counsel for the State.

This is an application under section 438, Cr.P.C. for grant of anticipatory bail to the petitioners in connection with Pattamundai P.S. Case No. 123 of 2021 corresponding to G.R. Case No.123 of 2021 pending in the Court of learned J.M.F.C., Pattamundai for the commission of the alleged offences punishable under sections 341, 294, 323, 307, 379, 506/34 of the Indian Penal Code.

Considering the submissions made by the learned counsel for the petitioners that it is a case and counter case,

// 2 // the ingredients of the offence under section 307 of the Indian Penal Code are not attracted and on hearing the learned counsel for the State, who submitted that nobody gave consent for any medical examination for which no medical examination has taken place and the fact that petitioners have been granted interim protection since 25.03.2021 and there is no material that they have misutilized their liberty, the interim order dated 25.03.2021 is made absolute.

The ABLAPL is accordingly disposed of.

Issue urgent certified copy as per Rules.
