Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

As directed, learned State Counsel has obtained instructions that DNA report has revealed that the petitioner is not the biological father of the child born to the victim. 4.

The petitioner is in custody since 04.03.2022 in connection with Gurundia P.S. Case No.07 of 2022 corresponding to G.R. Case No.132 of 2022 pending in the Court of learned S.D.J.M., Bonai for the alleged commission of offence under Section 376(1) of IPC.

Considering the above facts, materials on record, period of detention in custody and the fact that charge sheet has already been submitted, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case

without fail.
