Heard learned counsel for the parties.

Office note reveals that in the order dated 23.11.2022, the name of the petitioner has been wrongly typed as "Rabi Narayan Meher" in place of "Shibanee Behera" in the order sheet.

In view of the above, the order dated 23.11.2022 is recalled and a fresh order is passed herewith.

Learned counsel for the petitioner contended that the case of the petitioner is covered by the ratio decided by this Court in Udayanath Rout v. State of Odisha (WPC (OAC) No.2408 of 2015, disposed of on 09.08.2021). Therefore, direction be issued to the authority to consider the case of the petitioner in the light of said order.

Considering the contentions raised by learned counsel for the parties, this Court disposes of the writ petition with a direction to the State-opposite parties to consider the case of the petitioner in the light of the judgment passed by this Court in Udayanath Rout (supra) within a period of four months from the date of production/communication of this order. 7.
