The petitioner has filed this writ petition seeking direction to Orissa Mining Corporation Limited to extend the benefit of formula incorporated in Clause-35 of the contract under Annexure-13 to the contract under Annexure-7 for the year 200203. 3.

Since the period of contract for the year 2002-03 has already been expired, by efflux of time, the writ petition has become infructuous. However, liberty is granted to the petitioner to approach the appropriate forum, if any cause of action still survives.

With the aforesaid liberty, the writ petition stands disposed of.
