Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 01.02.2022 in connection with Jagatpur P.S. Case No.45 of 2022 corresponding to G.R. Case No.234 of 2022 pending in the Court of learned J.M.F.C.(R), Cuttack for the alleged commission of offence under Sections 395/363/34 of IPC.

The prosecution allegation is that the petitioner being associated with other accused persons committed dacoity of a Mahindra Pickup van which was loaded with liquor. They assaulted the driver of the van and took away the loaded van. In the meantime the van along with its load has been recovered. 5.

Having regard to the above facts and the period of detention of the petitioner in custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear

before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
