This is the successive journey of this Petitioner in connection with Ampani P.S. Case No.32 of 2019 corresponding to C.T. Case No.51 of 2019 (Sessions) pending on the file of the learned Additional Sessions Judge, Dharamgarh, running for the alleged commission of offence under sections 302/34, I.P.C. in filing this application for grant of bail in the above mentioned case. 3.
An application for grant of interim bail has also been filed by the petitioner on the ground of his illness. He, therefore, instead of pressing the bail application for disposal on merit, confines his submission with regard to grant of interim bail and accordingly, prays for disposal of both the BLAPL and I.A.

Learned counsel for the petitioner referring to the documents annexed to the application submits that the Petitioner being ill is now suffering from certain Neurological problems. He further submits that the health condition of the Petitioner remains unstable. He, therefore, prays for grant of interim bail to the Petitioner as his stay at home for some time under care of his family members and constant treatment of the physician is badly needed. In view of all these above, he urges for grant of interim bail to the petitioner.

Learned counsel for the State submits to have received no such instruction as yet.

Considering the submissions made and further keeping in view the surrounding circumstances, it is directed that the petitioner be released on interim bail in the aforesaid case till 30.05.2022 on such terms and conditions as the learned court in seisin of the case deems just and proper with further conditions that he will appear in person in the said court on the date/s fixed during the period and will positively surrender on 31st May, 2022.

The BLAPL and I.A. are accordingly disposed of. 7.
