1. This matter is taken up through hybrid arrangement.

2. Heard.

3. This writ petition has been filed by the petitioner seeking a direction from this Court to the opposite party No.3- District Education Officer, Ganjam to dispose of her representation under Annexure-5 series within a stipulated time.

4. Learned counsel for the petitioner submits that the petitioner had earlier approached this Court in W.P.(C) No.8437 of 2012. Pursuant to the order dated 09.07.2013 passed in W.P.(C) No.8437 of 2012, the petitioner approached the appellate forum i.e. opposite party No.2-Director, Secondary Education, Odisha, Bhubaneswar. The opposite party No.2-Director, Secondary Education, Odisha, Bhubaneswar, while passing the order 15.12.2014 in Appeal No.13 of 2013 filed by the petitioner, observed that the Secretary, Managing Committee of Nigamananda Uchha Bidyapitha, Karnoli, in the district of Ganjam had taken steps to terminate the service of the petitioner only to make illegal appointment. Hence, the Managing Committee was directed to take back the service of the petitioner

// 2 // to her former post and recommend her name to the higher authority for Block Grant/ Grant-in-Aid. He further submits that for consideration of her Grant-in-Aid with effect from 01.01.2014 instead of 11.03.2015, the petitioner had filed a representation before the opposite party No.3- District Education Officer, Ganjam, but the same is pending since 25.8.2021. Hence, the petitioner has filed this writ petition for early disposal of her representation.

5. However, at this juncture, learned counsel for the petitioner submits that the petitioner may be permitted to withdraw this writ petition with the liberty to seek remedy under Section 24-B of the Orissa Education Act, 1969.

6. Accordingly, this writ petition is disposed of as withdrawn giving liberty as submitted.

7. Urgent certified copy of this order be granted on proper application.
