This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard the learned counsel for the petitioner and learned counsel for the State.
This is an application under section 438 of Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Laxmisagar P.S. Case No. 140 of 2015 corresponding to T.R. Case No.1817 of 2016 pending in the Court of learned Sessions Judge, Khurda at Bhubaneswar for the commission of the alleged offences punishable under sections 147, 148, 341, 342, 323, 324, 325, 307, 336, 337, 354, 332, 294, 506, 149 of the Indian Penal Code read with section 3 of the PDPP Act and 7 of the Criminal Law
// 2 // Amendment Act and sections 3(1)(x)(2)(v) of the S.C. & S.T. (PoA) Act.
Perused the F.I.R. annexed to the anticipatory bail application.
Learned counsel for the State drew the attention of the Court that it is a case of the year 2015 and the petitioner has got criminal antecedents.
In view of the nature of accusation against the petitioner and since one of the offences is under section 3 of the S.C. & S.T. (PoA) Act and section 18 is a bar for entertaining the application for anticipatory bail, while not inclining to grant anticipatory bail to the petitioner, liberty is granted to the petitioner to surrender and move for bail in the Court below within a period of four weeks from today in the event of which the learned Court below shall dispose of the same in accordance with law expeditiously and claim of parity with the co-accused person, who is stated to have been released on bail, shall be taken into account at the time of adjudication of the bail application. The case records shall be made available to the Court concerned.
The ABLAPL stands disposed of.
