This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioners and learned counsel for the State.
This is an application under section 438, Cr.P.C. for grant of anticipatory bail to the petitioners in connection with Bharatpur P.S. Case No.21 of 2021 corresponding to C.T. Case No.334 of 2021 pending in the Court of learned S.D.J.M., Bhubaneswar for alleged commission of offences under sections 341, 323, 307/34 of the Indian Penal Code.
Considering the submissions made by the learned counsel for the State that the injured Suraj Kumar Pradhan has sustained simple injuries and the
// 2 // submission of the learned counsel for the petitioners that the ingredients of the offence under section 307 of the Indian Penal Code are not attracted and the fact that the petitioners have been granted interim protection since 13.04.2021 and there is no material that he has misutilized his liberty, the interim order dated 13.04.2021 is made absolute.
The ABLAPL is accordingly disposed of.
