1. Learned counsel appearing for the Petitioner seeks leave to withdraw the present petition with liberty to approach the Secretary, Excise Department for challenging the order of the Excise Commissioner recommending rejection of the Petitioner's application for an IMFL ON shop.

2. If such representation/application is made not later than 2nd January, 2023 the Secretary, Department of Excise will examine such representation and after giving the Petitioner hearing, dispose it of in accordance with law not later than 3rd April, 2023 and communicate the order to the Petitioner within a week thereafter. If aggrieved by such order, it will be open to the Petitioner to seek

appropriate remedies in accordance with law. The Court clarifies that it has not expressed any view on merits.
