The petitioner is a defaulting borrower and has challenged the demand notice dated 17th January, 2011, whereby the outstanding liabilities of Rs.6,88,310/- due on the said date was recalled on account of the loan account having been declared NPA. Further challenge is to the notice dated 21st August, 2011, whereby symbolic possession of the secured asset was assumed. Further prayer is for directing the Bank to settle the liabilities under an OTS scheme.

3. At the time of hearing, learned counsel for the petitioner states that the present writ petition has

// 2 // become infructuous in view of the loan account having been closed in view of the settlement arrived at with the Bank.

4. In view of the above submission, the writ petition is dismissed as infructuous.
