This matter is taken up through hybrid arrangement Order No.

(virtual/ physical) mode.

The Petitioners having been implicated in connection with Basta P.S. Case No.143 of 2020 corresponding to C.T. Case No.710 of 2020 pending on the file of learned J.M.F.C., Basta for alleged commission of offence under section -302/201/34 of the IPC, have filed this application under section-438 of the Cr.P.C. for their grant of anticipatory bail in the event of their arrest in the above mentioned case.

Heard learned Counsel for the Petitioners and learned Counsel for the State.

Considering the submissions made and on going through the materials as placed and other surrounding circumstances; while being not inclined to reconsider the prayer for grant of anticipatory bail to the Petitioners, this application is disposed of with the observation that in the event, the Petitioners surrender before the Court in seisin of the case within three weeks hence and move for

// 2 // their release on bail, the same shall be considered on its own merit; further taking into account all such developments which have taken place in the meantime including the factum of grant of bail to the co-accused persons on bail, if similarly situated with the Petitioners on the ground parity as per law and disposed of early in accordance with law.

The ABLAPL is accordingly disposed of.

Issue urgent certified copy as per rules.
