CORAM:
JUSTICE V. NARASINGH
ORDER
07.03.2022 Order No.
02.
1.
This matter is taken up through Hybrid Mode.
2.
Heard Mr. Ashok Das, learned counsel for the petitioner and Mr. B.K. Sharma, learned counsel for the Opposite PartyOdisha Lift Irrigation Corporation Ltd. 3.
The writ petition has been filed assailing the Order dtd.20.11.2015 passed by the Managing Director, Odisha Lift Irrigation Corporation, Bhubaneswar whereby the service of the petitioner as LVO on contractual basis was disengaged. 4.
It is submitted by the learned counsel for the petitioner that, though there is need for the service of the present petitioner illegally he has been disengaged.
5.
Learned counsel for the OLIC referring to the counter filed by the Corporation states that the petitioner's engagement
was for ongoing contracts and on completion of such contracts, there is no scope for continuance of the petitioner as a Light Vehicle Operator and there is no illegality in the action taken by the Corporation.
6.
Be that as it may, it is seen from the counter that, admittedly, the petitioner had served the organization as an LVO in different spells from 21.05.1997 to 31.08.2001 and again on 24.03.2011 to 16.02.2015 satisfactorily.
7.
Taking into account, the unblemished service of the petitioner, this Court feels that the interest of justice will be sub served, if the Opposite Parties take a sympathetic view and consider the case of the petitioner for fresh engagement without being influenced by the order at Annexure-7.
8.
With such observation, the writ petition stands disposed of. It shall be open for the petitioner to file a fresh representation ventilating his grievances before the concerned authorities, if so advised.
Urgent certified copy of this order be supplied as per rule.
