Mr. Pradhan, learned advocate appears on behalf of petitioner and submits, his client is transferee from allottee under Government Grants Act, 1895. Additional land, adjoining his client's plot, is to be given on lease. The authority is charging consent fee for mutating same in favour of his client. He refers to order dated 4th September, 2009 (annexure-6) regarding allotment of additional land to allottees under the Government Grants Act, 1895. 2.

On query from Court Mr. Pradhan draws attention to paragraph 12. On further query from Court Mr. Pradhan submits, his client be permitted to not press the writ petition,

to enable his client to bring fresh writ petition on better particulars of challenge against power of imposing consent fee.

Mr. Rout, learned advocate, Additional Standing Counsel appears on behalf of State.

Petitioner, if so advised, can file fresh writ petition. It has to be on a separate challenge, not contained herein. 5.

The writ petition is dismissed.
