This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner.

The petitioner has filed this writ petition seeking direction to opposite party no.4 to refund of excess amount of royalty of Rs.2,51,600/- in respect of the work "Construction of H.L. Bridge over river Mahendratanaya on Gosan-Gurandi-Longipur-Uppalada road in the district of Gajapati vide Agreement No.184 F2/201011" in terms of direction issued by Opposite Party No.3 under Annexure-5.

In course of hearing, learned counsel for the petitioner states that the petitioner has already made representation before the opposite party no.4-Tahasildar, Paralakhemundi vide Annexure-6 of the brief, and the same may be directed to be disposed of within a stipulated time taking into consideration Annexure-5, to which learned State Counsel has no objection.

As agreed by learned counsel for the parties, this Court, without expressing any opinion on the merits of the case, disposes of the writ petition directing opposite party no.4 to consider the representation filed by the petitioner vide Annexure-6 taking into

consideration Annexure-5 and pass appropriate order in accordance with law within a period of three months from the date of production of certified copy this order.
