The petitioner is a defaulting borrower in a Order No.

House Loan availed for a sum of Rs.3.5 lakhs from State Bank of India, Badashankha Branch, Puri in the year 2005, which upon non-deposit of the due installments was classified as NPA leading to issuance of a demand notice dated 02.01.2010 under Section 13(2) of the SARFAESI Act, 2002 recalling the outstanding liability of Rs.5,26,962/- due as on 30.11.2009 plus interest and expenses.

The prayer in the present writ petition is for a direction to the Bank to settle the account under the OTS Policy.

At the time of hearing, learned counsel for the Bank submits that the loan stands closed since

// 2 // 08.08.2014 upon deposit of the required amount determined under the liquidation proceedings. 4.

None has put in appearance to refute the aforesaid contention.

In view of the above, the writ petition is dismissed as infructuous.
