1. In the counter affidavit, it is admitted in Para-6 that the Petitioner's IMFL 'ON' Shop was closed "due to vehement public and members of market committee objection the shop could not be opened by the licensee and was closed since 20.06.2019".

2. In view of the above statement in the counter affidavit, a direction is issued to the Commissioner of Excise, Odisha to consider the Petitioner's representation in terms of the instant policy regarding waiver of MGQ.

3. Mr. Kousik Ananda Guru, learned counsel for the Petitioner states that the Petitioner undertakes to deposit outstanding license fees Rs.2,87,500/- within four weeks. Subject to the above deposit,

the decision on the Petitioners request for waiver of MGQ be communicated to him by the State authorities within a further period of two months thereafter.
