Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 06.01.2022 in connection with Nayapali P.S. Case No.7 of 2022 corresponding to T.R. Case No.06 of 2022 pending in the Court of learned District & Sessions Judge, Bhubaneswar for the alleged commission of offence under Sections 20(b)(ii)(C)/29 of NDPS Act.

It is alleged that the petitioner was travelling in a Car, in which contraband ganja weighing 46 kg 208 grams were being carried.

It is submitted that the petitioner is a professional driver and had no knowledge about the contents of the luggage kept by the occupants in the dickey of the vehicle. It also appears that as per the seizure list only a mobile phone was seized from the possession of the petitioner.

Considering the above facts and the period of detention of the petitioner in custody, I am inclined to allow the payer for bail. Let
the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
