1. This matter is taken up through hybrid mode.

2. Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.

3. The Petitioner is in custody since 19th September, 2021 in connection with Harichandanpur P.S. Case No.126/2021 corresponding to S.T. Case No.1/81 of 2022-21 pending in the court of learned Addl. Asst. Sessions Judge (Women) of Keonjhar for the alleged commission of the offence under Sections 363/342/376/323/506/34 of the I.P.C.

4. It is alleged that the Petitioner forcibly took away the victim to his house and thereafter to another place and forcibly

// 2 // committed sexual intercourse with her whereupon she was rescued by her family members. The Petitioner is also said to have threatened the victim and her family members with dire consequences for which the victim has taken shelter in her maternal uncle's house.

5. Considering the submissions, the materials on record, the period of detention in custody and in particular the statement of the victim recorded under Section 164 of Cr.P.C., I am inclined to allow the prayer for bail.

6. Let the Petitioner be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that he shall not threaten, coerce or pressurize the victim in any manner whatsoever, he shall to attempt to make any contact whatsoever with the victim, he shall appear before the court below on each date of posting of the case without fail and in case of even a single default, necessary orders shall be passed by the court to take him to custody again.

7. The BLAPL is disposed of.

8. Urgent certified copy of this order be granted on proper application.
