Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 22.10.2021 in connection with Khurda P.S. Case No.495 of 2018 corresponding to G.R. Case No.1160 of 2022 pending in the Court of learned S.D.J.M., Khurda for the alleged commission of offence under Sections 326/307/34 of IPC read with Section 25 & 27 of Arms Act. 4.

The allegation is that the petitioner in association with some other persons assaulted the injured, Sarat Behera by means of deadly weapons including a country made pistol. 5.

It appears that co-accused persons, namely Dipu @ Dipak @ Deepak Kumar Pradhan and Sanju @ Sanjay Kumar Pradhan have been granted bail by this Court in BLAPL Nos.3711 of 2021 and 10934 of 2021 respectively.

From the materials on record there is nothing to differentiate the present petitioner from the accused persons who have been granted bail. Having regard to the above facts and the period of

detention of the petitioner in custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the Court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
