This matter is taken up through video conferencing mode. 2.

Heard Mr. S.K. Samantaray, learned counsel for the petitioner, Mr. A.R. Dash, learned Additional Government Advocate and Mr. Amitav Das, learned counsel for opposite party Nos.3 & 4.

According to Mr. Samantaray, the petitioner is aggrieved by the inaction of the authorities in paying him compensation though a portion of his land has been used for constructing National Highway in the year 2019. He further submits that though the petitioner has submitted a representation on 25.02.2021 under Annexure-2 series to the Chief Engineer, National Highways, Odisha (opposite party No.3) however, he prays that liberty may be granted to the petitioner to file a fresh representation before the opposite party No.3 by highlighting all his grievances and the said opposite party be directed to take a

// 2 // decision on such motion within a specific time period. 5.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court grants liberty to the petitioner to file a fresh representation before opposite party No.3 through registered post within a period of two weeks from today. In the event, such a representation is filed along with a copy of this order, the opposite party No.3 is directed to take a decision on the same in accordance with law within a period of three months from the date of receipt of such representation and communicate the result of such exercise to the petitioner.

Accordingly, this writ petition is disposed of. 7.

As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed vide Court's Notice No.4587, dated 25th March, 2020, modified by Notice No.4798, dated 15th April, 2021, and Court's Office Order circulated vide Memo Nos. 514 and 515 dated 7th January, 2022.
