This matter is taken up through hybrid mode.

Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are seeking pre-arrest bail in connection with G.R. Case No.345 of 2022 arising out of Khallikote P.S. Case No.147 of 2022 pending in the Court of learned J.M.F.C., Khallikote for commission of offence punishable under Sections 147/148/452/294/323/324/307/427/354-B/379/149 of I.P.C read with Sections 3 & 4 of the Explosive Substances Act. 4.

Taking into account the specific overt act as alleged against the petitioner No.3, this court is not inclined to exercise its jurisdiction under 438 of Cr.P.C. vis-à-vis the said petitioner. The ABLAPL accordingly stands dismissed qua the Petitioner No.3.

Taking into account the nature of allegations and the role ascribed to the Petitioner Nos.1, 2, 4 to 9, this Court directs that on surrendering within three weeks hence, the petitioners shall be released on bail by the Court in seisin over the matter on such terms as deemed just and proper.

Accordingly, the ABLAPL stands disposed of.
