Heard learned counsel appearing for the parties. Order No.

Tit is alleged that even though the proceeding vide Encroachment Case No.963/2020 with P.R.No.417 dated 28.10.2020 and the petitioner filing his objection vide Annexure-8 to such show cause notice, in absence of conclusion of such proceeding, there is threatening by the Tahasildar concerned to the petitioner. This Court finds the proceeding involved herein was initiated in the year 2020 might have been concluded.

Be that as it may, in disposal of the writ petition this Court observes in the event the proceeding indicated hereinabove is still pending, petitioner should not be evicted from the disputed property at least till disposal of the proceeding.
