Heard learned counsel for the parties.

The petitioner has filed this writ petition seeking to quash the observation made in the order dated 03.09.2010 passed by the Orissa Administrative Tribunal, Bhubaneswar in O.A. No. 2196 of 2002 under Annexure-4 to the extent that the petitioner is not entitled to get salary for the period he was out of job. 4.

Mr. M.K. Sahoo, learned counsel for the petitioner contended that though pursuant to the order dated 03.09.2010 passed by the tribunal, the petitioner has been continued in service, but because of the observation made by the tribunal that petitioner is not entitled to get salary for the period he was out of job, he has approached this Court by filing the present writ petition.

Mr. J.P. Pattnaik, learned Government Advocate contended that pursuant to the order passed by the tribunal, the relief claimed by the petitioner has already been granted. Therefore, the present writ petition cannot sustain in the eye of law. 6.

Having heard learned counsel for the parties and after going through the records, this Court is not inclined to entertain this writ petition at this stage. However, if the petitioner has any grievance,

it is open to him to pursue his remedy before the appropriate authority in accordance with law.

With the aforesaid liberty, the writ petition stands disposed of.
