CORAM:
DR. JUSTICE B.R. SARANGI MISS JUSTICE SAVITRI RATHO
ORDER
17.03.2022 State of Odisha Order No.
06.
This matter is taken up through hybrid mode.
2.
None appears for the petitioner at the time of call. 3.
Heard Mr.S.N.Nayak, learned Addl. Standing Counsel. 4.
The petitioner has filed this writ petition challenging the order dated 02.11.2011 passed by the Odisha Administrative Tribunal, Cuttack Bench, Cuttack in O.A. No.2156 (c) of 1998, rejecting the claim of the petitioner, as there are no sufficient grounds to re-instate him in service. 5.
As it appears, against the order of dismissal, the petitioner has approached tribunal, and the tribunal relying upon the judgment of the apex Court in the case of Hiran Mayee Bhattacharyya v. S.M.Schools for Girls, (2002) 10 SCC 293, held that the benefit cannot be extended to the petitioner, as there are no sufficient grounds to re-instate him in service.
6.
In the above view of the matter, this Court does not find any error apparent on the face of record so as to warrant
interference by this Court. Accordingly, the writ petition merits no consideration and the same is hereby dismissed. Jagdev/Bichi (DR. B.R. SARANGI) JUDGE (SAVITRI RATHO) JUDGE
