1. Heard Mr.Panda, learned counsel for the Petitioner and Mr.Mohanty, learned Additional Standing Counsel for the State.

2. This is an application under Section 439 Cr.P.C. for grant of bail to the Petitioner in connection with Spl.C.T.Case No.16 of 2019 arising out of Spl.G.R.Case No.18 of 2019 pending in the court of the learned Additional Sessions Judge-cum-Spl.Judge, Deogarh for alleged commission of offence under Sections 363/376-D of the I.P.C. and Section 6 of POCSO Act.

3. It is submitted that the Petitioner is inside custody since 2.11.2019 and in the meantime, the victim and her father have been examined in course of trial as P.Ws.1 and 2. It is further submitted that both these witnesses have not supported the prosecution case and did not say anything against the present Petitioner.

4. Upon hearing Mr.Mohanty, learned Additional Standing Counsel for the State and perusal of the evidence of P.Ws.1 and 2, it is directed that the Petitioner be released on bail in the aforesaid case on such terms and conditions to be fixed by the learned court below in seisin over the matter.

5. The BLAPL is disposed of.

6. Urgent certified copy of this order be granted on proper application.
