This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner.

The petitioner has filed this writ petition seeking direction to the opposite party authority to treat the petitioner as qualified tenderer and after completion of tender process since it being the L1 bidder, the said contract may be awarded to it.

In course of hearing, learned counsel for the petitioner states that the petitioner has already made representation before the opposite party-General Manager, Food Corporation of India vide Annexure-3, and the same may be directed to be disposed of taking into consideration Annexures-4 & 5 within a stipulated time.

Considering the contentions raised by learned counsel for the petitioner, this Court, without expressing any opinion on the merits of the case, disposes of the writ petition directing the opposite party to consider the representation filed by the petitioner vide Annexure-3 taking into consideration Annexures-4 & 5 and pass appropriate order in accordance with law within a period of four weeks from the date of production of certified copy this order.
