1. Since it is the case of Appellant that the Respondent is still occupying the plot in question unauthorizedly, it is open to the Appellant to seek appropriate remedy as available under the statute for that purpose.

2. Therefore, this Court sees no reason to interfere with the impugned order of the learned Single Judge.
